WIRE FUNDS TRANSFER AGREEMENT AND NOTICE

1. The credit union may establish or change cut-off times for the receipt and processing of wire funds transfers requests, amendments or cancellations. Unless other times are posted for the various types of funds transfers, the cut-off time will be 9:00 a.m. for both domestic wire transfers and foreign wire funds transfers on each business day that the credit union is open. Business days are Monday through Friday, except State Holidays. Payment orders, cancellations, or amendments received after the applicable cut-off time may be treated as having been received on the next business day and processed accordingly.
2. If you give the credit union a payment order which identifies the beneficiary (recipient of the funds) by both name and identifying number or account number, payment may be made by the beneficiary's bank on the basis of the identifying number or bank account number, even if the number identifies a person different than the named beneficiary. This means that you will be responsible to the credit union if the wire funds transfer is completed on the basis of the identification number you provided the credit union.
3. If you give the credit union a payment order which identifies an intermediary or beneficiary's bank by both name and an identifying number, a receiving bank may rely on the number as the proper identification even if it identifies a different person than the named bank. This means that you will be responsible for any loss or expenses incurred by a receiving bank which executes or attempts to execute the payment order in reliance on the identifying number you provided.
4. In accordance with the National Automated Clearing House Rules, the credit union will not provide you with next-day notice of the receipt of the wire funds transfer. The credit union will provide you with notification of the receipt of all wire funds transfers by including such items in your periodic account statements, which we provide. You may, of course, inquire between receipts of periodic statements whether or not a specific wire funds transfer has been received by accessing Online Banking, using the Private Line or calling the credit union.
5. For security purposes, this Wire Funds Transfer Request is subject to HSFCU's Security Procedures that involve verifying government-issued photo identification (i.e. State ID, Drivers License or Passport), signature identification and/or call back procedure. You agree that this Wire Funds Transfer Request may be delayed until such Security Procedures are completed. At our discretion, we may request a certified copy of your picture identification.
6. The credit union has the right to refuse any stop payment or amendment request relating to wire funds transfers. The credit union may make a reasonable effort to act on your request. However, we will not be liable to you if for any reason the payment order is not canceled or amended. You agree to reimburse us for any costs, losses, or damages that we incur in connection with your request to cancel or amend the payment order.
7. If the credit union becomes obligated under Article 4A to pay interest to you, you agree that the rate of interest to be paid shall be equal to the current dividend rate, on a daily basis, applicable to the account at the credit union to which the wire funds transfer should have been made or from which the wire funds transfer was made.
8. If a wire funds transfer is rejected, the credit union will send notice of rejection no later than its next business day. The credit union will not be responsible for any loss resulting from the rejection of the wire funds transfer or the delay in receiving the notice of rejection.
9. Fees, as stated in the Fee Schedule, are non-refundable once your request is processed.
